“1040 Tax-Time Payday” Sweepstakes

OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

DATES OF THE SWEEPSTAKES: The “1040 Tax-Time Payday” Sweepstakes (the “Sweepstakes”) begins at 12:00 AM (Eastern Time [“ET”]) on December 11, 2018 and ends at 11:59 PM ET on April 30, 2019 (the “Sweepstakes Period”). The Sweepstakes Period will be subject to four (4) entry periods (each, an “Entry Period”) as outlined in the “ENTRY PERIODS” section of these Official Rules.

ELIGIBILITY: To enter the Sweepstakes, you must be a lawful permanent resident in one (1) of the fifty (50) United States or the District of Columbia (excluding Vermont, Puerto Rico and the U.S. territories and possessions) and at least the age of majority in your state of residence (nineteen (19) in Alabama, Nebraska, twenty-one (21) in Mississippi, and eighteen (18) in all other states) with a valid Social Security number at the time of entry (the “Entrant”). Employees of Green Dot Corporation (the “Sponsor”) and each of its affiliated companies, parents, subsidiaries, and advertising and promotion agencies, including, but not limited to National Sweepstakes Company, LLC (the “Sweepstakes Administrator”), herein (collectively, “Sweepstakes Entities”), and any service partners, as well as The Bancorp Bank, MetaBank®, MasterCard International Inc. and Visa U.S.A. Inc. (collectively, the “Releasees”) and their immediate families (i.e. parents, children, siblings, spouse) and members of their households (whether related or not) are ineligible to participate in this Sweepstakes. Sweepstakes is void in Vermont, Puerto Rico, U.S. territories and possessions, outside of the fifty (50) United States, District of Columbia and where restricted or prohibited by law. By entering, Entrants agree to be bound by these Official Rules, including all eligibility requirements and the decisions of the Sponsor, which are final and binding.

ENTRY PERIODS: For the purposes of this Sweepstakes, there will be one (1) drawing associated with each Entry Period. There will be twenty-five (25) entry period prize winners (each an “Entry Period Prize Winner”) for each Entry Period drawing (for a total of one hundred (100) Entry Period Prize Winners throughout the Sweepstakes). Each Entry Period will start and end on the date and time in the Entry Period chart below. All entries must be submitted during this time period in order to be included for that Entry Period’s drawing. At the end of the Sweepstakes Period, there will be one (1) grand prize drawing to selected ten (10) grand prize winners (each a “Grand Prize Winner”). All winning and non-winning eligible entries received during each Entry Period will be eligible for the Grand Prize drawing.

ALL NON-WINNING ELIGIBLE ENTRIES FROM THE PREVIOUS ENTRY PERIOD(S) WILL NOT CARRY OVER TO SUBSEQUENT ENTRY PERIOD DRAWINGS. HOWEVER, ALL ENTRIES WILL BE ELIGIBLE FOR THE GRAND PRIZE DRAWING.

HOW TO ENTER: There are three (3) ways to receive entries into the Sweepstakes.

  1. INITIAL ENTRY:
    Federal Tax Refund Direct Deposit Entry: Make a qualifying electronic direct deposit of your FEDERAL tax refund of $5 or more during the Sweepstakes Period to your personal card account for one of the following cards: AccountNow Gold Visa® Prepaid Card, AccountNow Prepaid Visa Card or AccountNow Prepaid Mastercard®, Prepaid Visa RushCard, Green Dot branded reloadable prepaid Visa or Green Dot branded reloadable prepaid Mastercard cards, Green Dot 5% Cash Back Visa Debit Card, Green Dot Affinity Brands card (NASCAR, Halogen), Uber VisaDebit Card from GoBank, GoBank branded Mastercard or GoBank branded Visa Debit cards, 1199 SEIU prepaid card, TPG card, One Main prepaid card, or Walmart MoneyCard prepaid cards (each, a “Card”) and receive one (1) entry for such qualifying direct deposit. SEIU prepaid cards, TPG cards, One Main prepaid cards, Walmart MoneyCard prepaid cards may only be obtained from a tax preparer. PLEASE NOTE: A qualifying electronic deposit of a FEDERAL tax refund is dependent upon the date on which the qualifying electronic deposit has been posted to the respective Card account. In order to qualify as an entry, the eligible electronic deposit of a FEDERAL tax refund must be posted to the respective Card account by 11:59 PM ET on April 30, 2019. A direct deposit of a FEDERAL tax refund posted to the respective Card account after 11:59 PM ET on April 30, 2019 will not be considered an entry.

  1. TO ENTER WITHOUT A TAX REFUND DIRECT DEPOSIT OR VIA BONUS ENTRIES:

    Mail-in Entry: To enter without having or using a Card or making a Tax Refund Direct Deposit or Bonus Entry, on a plain 3” x 5” card, legibly print or type your name, age, complete address, city, state, zip code, home phone number (including area code), and email address (if any). Then, mail your 3” x 5” card in a postage-affixed sealed envelope to: “1040 Tax-Time Payday” Sweepstakes, P.O. Box 10028, Rochester, NY 14610. Mail-in entries must be postmarked and received by the dates indicated in the Entry Period Chart in the “ENTRY PERIODS” section of these Official Rules to be eligible for the applicable Entry Period drawing. No mechanically or programmatically reproduced entries are permitted. One (1) entry per envelope. Neither the Sponsor nor the Sweepstakes Administrator will verify receipt of entries for Entrants. All entries submitted become the sole property of Sponsor and will not be returned. Sponsor is not responsible for late, misdirected, illegible, or damaged mailed entries.

Limit of ten (10) entries per Entrant for each Entry Period, regardless of method of entry. There is a limit of forty (40) entries per Entrant for the Grand Prize drawing. Entrants may only use one (1) Card and one (1) email address to participate in this Sweepstakes. Entries received from any Entrant, email address or Card in excess of the above stated limitation will be void.

In the event of uncertainty as to the identity of an Entrant, that Entrant will be disqualified. Any attempt by any Entrant to obtain more than the stated number of entries by using multiple/different identities, Cards, email addresses, accounts, and/or any other methods will void that Entrant’s entries and that Entrant may be disqualified from the Sweepstakes. No mechanically or programmatically reproduced entries are permitted. Sponsor will not verify receipt of entries for Entrants. All entries submitted become the sole property of Sponsor and will not be returned. Sponsor is not responsible for lost, late, misdirected, illegible or damaged entries, deposits or failed internet connections.

RANDOM DRAWINGS/ODDS OF WINNING:

Entry Period drawings: On or about the drawing dates outlined in the Entry Period Chart in the “ENTRY PERIODS” section of these Official Rules, twenty-five (25) Entry Period Prize Winners will be selected in a random drawing for each Entry Period conducted under the supervision of the Sweepstakes Administrator, an independent judging organization, whose decisions are based on their sole discretion and interpretation of these Official Rules, and are final and binding in all respects. All non-winning eligible entries from the previous Entry Period drawings will carry over to subsequent Entry Period drawings. Odds of winning depend upon the total number of entries received during the respective Entry Period.

Grand Prize drawing: On or about May 10, 2019, ten (10) Grand Prize Winners will be selected from all eligible entries received throughout the Sweepstakes Period in a random drawing conducted under the supervision of the Sweepstakes Administrator, an independent judging organization, whose decisions are based on their sole discretion and interpretation of these Official Rules, and are final and binding in all respects. Odds of winning depend upon the total number of entries received during the Sweepstakes Period.

PRIZES:

Grand Prizes (10): Ten (10) grand prizes of $1,040 cash (each a “Grand Prize”) will be awarded to each grand prize winner (the “Grand Prize Winner”). If a Grand Prize winner has an open Card account, the Grand Prize will be credited to his/her Card account. In the event that a Grand Prize Winner does not have an open Card account, the Grand Prize will be awarded in the form of a check. Total approximate retail value (“ARV”) of all Grand Prizes is $10,400.

Entry Period Prizes (100) (25 awarded per Entry Period): Twenty-five (25) Entry Period Prizes of $104.00 cash (each an “Entry Period Prize”) will be awarded to each Entry Period Prize Winner. If an Entry Period Prize Winner has an open Card account, the Entry Period Prize will be credited to his/her Card. In the event that an Entry Period Prize Winner does not have an open Card account, the Entry Period Prize will be awarded in the form of a check. Total ARV of all Entry Period Prizes is $10,400.

The total maximum ARV of all prizes to be awarded is $20,800. For purposes of these Official Rules, the Entry Period Prize Winners and Grand Prize Winners will be collectively referred to as “Prize Winner(s)”, and the Entry Period Prizes and Grand Prizes will be collectively referred to as “Prize(s)”.

PRIZE RESTRICTIONS: The amount of the Prize that, if loaded to a Prize Winner’s Card, would cause a Prize Winner’s Card balance to exceed the Card’s maximum balance limit will be awarded in the form of a check. No prize substitution, except at Sponsor’s sole discretion or as otherwise provided herein. Prize is not transferable prior to award. All taxes on any Prize are the sole responsibility of the Prize Winner and are not transferable. Prize Winner is solely responsible for all other expenses not specified herein, including but not limited to applicable taxes, Card fees, and check cashing fees.

Sponsor reserves the right to exclude from the Sweepstakes any potential Prize Winner who is suspected of theft, fraud, or any criminal activity related to Sponsor or its affiliates. Entries associated with fraudulent Cards or other unauthorized use of Cards and entries associated with any similar fraudulent or inappropriate activities relating to any such Cards will be void and all such Entrants may be disqualified.

NOTIFICATION/PRIZE CLAIMS:

Grand Prizes: Potential Grand Prize Winners will be contacted by mail within five (5) business days of the drawing date by the Sponsor or Sponsor representative (“Notification”). If a Grand Prize Winner cannot be contacted within five (5) business days of the first attempt to contact him/her or the Grand Prize Winner does not respond to the Notification within the date and time indicated within the Notification, then that Grand Prize Winner will be disqualified and an alternate Grand Prize Winner will be selected through a random drawing from among all remaining eligible entries received during the Sweepstakes Period.

Except where prohibited, the potential Grand Prize Winners must sign and return, within five (5) business days of receipt, an Affidavit of Eligibility/Liability/Publicity Release and an IRS W-9 Form (the “Paperwork”) in order to claim the Grand Prize. Except where prohibited by law, Grand Prize Winner’s entry and acceptance of the Grand Prize constitutes permission for the Sweepstakes Entities to use said Grand Prize Winner’s name, photograph, likeness, statements, biographical information and voice on a worldwide basis, and in all forms of media, in perpetuity, without further compensation. If the potential Grand Prize Winner fails to return the Paperwork within five (5) days of receipt of the Paperwork, or if an Entrant is found to be ineligible, or if he/she does not comply with the Official Rules, then the potential Grand Prize Winner will be disqualified and an alternate Grand Prize Winner will be selected through a random drawing by the Sweepstakes Administrator from the remaining non-winning entries received during the Sweepstakes Period. If the Notification or Prize is returned as undeliverable, this will result in disqualification and an alternate Grand Prize Winner will be selected as outlined above. The Sponsor, or a third party acting on its behalf, must report the value of the Grand Prize to the Internal Revenue Service in the year the Grand Prize is received by the Grand Prize Winner and will be reported to the Grand Prize Winner and the Internal Revenue Service in the form of a Form 1099. In the event it is deemed during the verification process that the potential Grand Prize Winner does not have a unique, personal, and valid social security number for Sponsor (or any party acting on its behalf) to report the tax liability associated with acceptance of his/her Grand Prize, the potential Grand Prize Winner will be disqualified and another potential Grand Prize Winner will be selected from among the remaining eligible entries received during the Sweepstakes Period. Valid social security numbers will be determined by IRS requirements.

Entry Period Prizes: Potential Entry Period Prize Winners will be notified upon receipt of his/her Entry Period Prize either via credit (if Entry Period Prize Winner has an open Card account) or check. All Entry Period Prizes will be awarded within four (4) to six (6) weeks after the drawing date. In the event that the Entry Period Prize is returned as undeliverable, such Entry Period Prize Winner forfeits his/her right to the Entry Period Prize and an alternate Entry Period Prize Winner will be selected from among all non-winning entries received during the respective Entry Period.

SWEEPSTAKES RULES OF PARTICIPATION: This Sweepstakes is subject to all applicable federal, state and local laws. By participating, Entrants agree to be bound by these Official Rules and the decisions of the Sponsor and waive any right to claim ambiguity in the Sweepstakes or these Official Rules. Sweepstakes Entities are not responsible for lost, late, misdirected, undeliverable, illegible, or incomplete entries, whether due to system errors or failures, faulty transmissions or other telecommunications malfunctions, entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, faulty transmissions, technical malfunctions, or otherwise. Sponsor may prohibit an Entrant from participating in the Sweepstakes or winning a Prize if, in its sole discretion, it determines that said Entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other Entrants, Sponsor, or Sweepstakes Entities. If for any reason this Sweepstakes is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor or the Sweepstakes Administrator which corrupt or affect the administration, security, fairness, integrity or proper conduct of the promotion, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and randomly draw from those entries received up to the cancellation/suspension date. CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

NO LIABILITY: By entering, Entrants and Prize Winners agree to comply with all Official Rules, as stated and agree to release, discharge, indemnify and hold harmless the Sponsor, its affiliates, and their respective agents, representatives, officers, directors, shareholders, and employees, including the aforementioned Releasees in the “ELIGIBILITY” section of these Official Rules, (now collectively defined as the “Releasees”) from any claims, actions, injury, loss or damage of any kind, including, without limitation, personal injury or death, resulting, directly or indirectly, in whole or in part, from participating in this Sweepstakes or form the acceptance, possession, or use or misuse of a Prize. This limitation of liability is a comprehensive limitation of liability that applies to all damages of any kind, including, without limitation, compensatory, direct, indirect, or consequential damages; loss of data, income or profit; loss of or damage to property; and claims of third parties. Entrants agree that Releasees have not made nor are in any manner responsible or liable for any warranty, representation, or guarantee, statutory, express or implied, including, without limitation, the implied warranties of merchantability, title, and fitness for a particular purpose, in fact or in law, relative to this Sweepstakes.

CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of New York, USA.

WINNER’S LIST/RULE REQUEST: To receive a Prize Winner list or an additional copy of these Official Rules, send a self-addressed, stamped business-size (#10) envelope to be received by June 15, 2019 to: “1040 Tax-Time Payday” Sweepstakes, P.O. Box 10505, Rochester, NY 14610. Please specify “Winner List” or “Rules Request.”

PRIVACY/REMOVAL REQUEST: All identity and Card transaction information used to enter you in the Sweepstakes shall be kept confidential and secure, and will be subject to the privacy policy or policies governing your Card account. National Sweepstakes Company, LLC will not use or share your information for any reason other than to administer the Sweepstakes. To have yourself removed as an entrant in the Sweepstakes, please send your name and address on a 3” x 5” card in a postage-affixed sealed envelope to “1040 Tax-Time Payday” Removal Request, 80 Rockwood Place, Suite 104, Rochester, NY 14610.

SWEEPSTAKES ADMINISTRATOR: This Sweepstakes is being administered by National Sweepstakes Company, LLC, 80 Rockwood Place, Suite 104, Rochester, NY 14610, an independent judging organization, whose decisions will be final regarding the conduct of this Sweepstakes.

“Fall” Sweepstakes

OFFICIAL RULES

NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES.

The “Fall” Sweepstakes (the “Sweepstakes”) is intended only for legal United States residents in all states excluding Vermont who have reached the age of majority in his/her state of residence at the time of entry and shall only be construed and evaluated according to U.S. law. Do not enter this Sweepstakes if you are not located in the U.S. at the time of entry or if you reside in the U. S. within the state of Vermont.

Each Entry Period will begin at 12:00:01 a.m. ET on the specified start date and end at 11:59:59 p.m. ET on the specified end date. The Sponsor’s database is the official time-keeping device for the Sweepstakes. There are two (2) ways to enter the Sweepstakes during the Sweepstakes Period:

  1. Deposit/Cash Load – Entrants will automatically obtain one (1) Sweepstakes entry every time they make a cash load or direct deposit of any amount to their RushCard. Those Entrants that are not current RushCard cardholders can create a RushCard account to enter the Sweepstakes as described above. To become a RushCard card member, visit www.RushCard.com and complete the on-line application.
  1. By Mail (“AMOE”) – To enter via mail without being a RushCard cardholder account or making a cash load or direct deposit print your full name, complete mailing address, phone number, and email address on a 3”x5” card and mail with proper postage to: RushCard “Fall” Sweepstakes, PO Box 961, Macedon, NY 14502. Mail-in entries must be received by the end date specified for an applicable Entry Period to be eligible for such Entry Period’s drawing or be postmarked by December 24, 2018 and received by December 29, 2018 to be eligible for the Grand Prize drawing. LIMIT ONE (1) MAIL-IN ENTRY PER ENVELOPE.

To be valid, each entry must provide all requested information. Each valid entry qualifies the Entrant for a chance to win the Prizes associated with the applicable Entry Period when the entry was received and a chance to win the Grand Prize. Released Parties (as defined below) are not responsible for: lost, late, incomplete, invalid, unintelligible, illegible, misdirected or postage-due mailed entries. All entries become the exclusive property of Sponsor and will not be acknowledged or returned. GENERAL CONDITIONS: If for any reason the operation or administration of this Sweepstakes is impaired or incapable of running as planned for any reason, including but not limited to (i) infection by computer virus, bugs, (ii) tampering, unauthorized intervention, (iii) fraud, (iv) technical failures, or (v) any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes in whole or in part, at any time, without notice and award the Prizes (defined below) for the applicable Entry Period(s) using all non-suspect eligible entries received for the Entry Period(s) in question as of, or after (if applicable) this cancellation, termination, modification or suspension date, or in any manner that is fair and equitable and best conforms to the spirit of these Official Rules. RELEASE OF LIABILITY AND INDEMNIFICATION: As consideration for entering the Sweepstakes, all Entrants agree to RELEASE, DISCHARGE AND COVENANT NOT TO SUE the Sponsor, the Administrator, and each of their respective direct and indirect affiliates, divisions, parent and subsidiary companies, officers, employees, shareholders, representatives, members, directors, owners, agents, insurers, attorneys, predecessors, successors, and assigns thereof (collectively, the Released Parties), from and against all claims, damages, charges, injuries, losses, proceedings, suits, actions (including but not limited to tort actions, product liability actions, wrongful death actions, warranty actions, breach of contract actions, privacy and defamation actions, misappropriation of likeness actions, identity theft, loss of consortium claims), expenses and attorney fees that they or anyone on their behalf (including but not limited to their heirs, representatives or next of kin) have or might have for any death, injury, damage or claimed injury or damage arising out of, involving or relating to their participation in the Sweepstakes, including, but not limited to, any claim that the act or omission complained of was caused in whole or in part by the strict liability or negligence in any form of the Released Parties.

Additionally, as consideration for entering the Sweepstakes, all Entrants agree to INDEMNIFY, HOLD HARMLESS, AND DEFEND the Released Parties in any action or proceeding from and against all claims, damages, charges, injuries, losses, proceedings, suits, actions (including but not limited to tort actions, product liability actions, wrongful death actions, warranty actions, breach of contract actions, privacy and defamation actions, misappropriation of likeness actions, identity theft, loss of consortium claims), expenses and attorney fees that they or anyone on their behalf (including but not limited to their heirs, representatives or next of kin) have or might have for any death, injury, damage or claimed injury or damage arising out of, involving or relating to their participation in the Sweepstakes or for their failure to comply with the terms of the above release provision. This agreement to indemnify, hold harmless and defend applies even if the act or omission complained of was allegedly caused in whole or in part by the strict liability or negligence in any form of the Released Parties.

Furthermore, Sweepstakes Entrant expressly waives and relinquishes all rights and benefits afforded by Section 1542 of the Civil Code of the State of California, and does so understanding and acknowledging the significance and consequence of such specific waiver of Section 1542. Section 1542 of the Civil Code of the State of California states:

“A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.”

Thus, notwithstanding the provisions of Section 1542, and for the purpose of implementing a full and complete release and discharge of the Released Parties, Entrant expressly acknowledges that this release is intended to include, in its effect, without limitation, all claims which Entrant does not know or suspect to exist in Entrant’s favor at the time of execution hereof, and that this release contemplates the extinguishment of any such claim or claims. Entrant acknowledges and agrees that this general release is specifically intended to be as broad and comprehensive as permitted by California law.

DRAWINGS AND NOTIFICATION: The potential Prize Winners will be selected in eleven (11) random drawings (one (1) drawing per Entry Period) from among all eligible entries received by the Administrator, whose decisions are final and binding. The weekly Entry Period Prize drawings will be conducted on or about the 3rd business day following each Entry Period. The Grand Prize Entry Period drawing will be conducted on or about January 2, 2019. Odds of winning a weekly Entry Period Prize will depend on the total number of eligible entries received during the Entry Period in question. Non-winning entries from one Entry Period drawing will not carry over to subsequent Entry Period drawings but will be included the Grand Prize drawing. Odds of winning a Grand Prize will depend on the total number of eligible entries received throughout the Sweepstakes Period. If a Prize Winner is a RushCard cardholder, the Prize will be awarded as a RushCard card load. If a Prize Winner is not a RushCard cardholder, the Prize will be awarded as a check. All other expenses associated with Prize acceptance or usage not specifically mentioned herein are the responsibility of the Winners. All decisions by the Sponsor as to Prize Winners and Prizes are final. No substitution, assignment or transfer of the Prize is permitted, except by the Sponsor, who reserve the right to substitute the Prize with another of equal or greater value. Limit of one (1) prize per person throughout the Sweepstakes Period.

By accepting a Prize, the Winners agree to release and hold harmless the Released Parties, each of their related companies, and each of their respective officers, directors, employees, shareholders, and agents from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of the Prize. The potential Grand Prize Winners must each sign and return to the Administrator, within five (5) days of the date of notice or attempted notice is sent, an Affidavit of Eligibility, Liability & Publicity Release in order to claim his/her Prize. Note: The Affidavit sent to a potential Grand Prize Winner will require that the Winner provide their Social Security Number to the Administrator, which will be used solely for tax reporting purposes. The Prize Winners will each be responsible for all local, state, and federal taxes associated with the receipt of the Prize. The Grand Prize Winners must note that the value of their accepted Prize is taxable as income and an IRS Form 1099 will be filed in the name of the Winner for the value of their Prize. All Winners are solely responsible for all matters relating to the Prize after it is awarded. By participating, Entrants release and agree to hold harmless the Released Parties from any and all liability for any injuries, death or losses or damages to persons or property AS WELL AS CLAIMS/ACTIONS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY that may arise from participating in this Sweepstakes or its related activities or the acceptance, possession, use or misuse of, or any harm resulting from the acceptance, possession, use or misuse of the Prize. DISPUTES: By entering the Sweepstakes, Entrants agree that i) Any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes, or any Prizes awarded, shall be resolved individually, without resort to any form of class action; ii) Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes but in no event attorney fees and iii) Under no circumstances will any Entrant be permitted to obtain any award for, and Entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrants and Sponsor or the Released Parties in connection with the Sweepstakes, shall be governed by, and construed in accordance with United States law. SEVERABILITY: The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. If any provision of the Official Rules is determined to be invalid or otherwise unenforceable, the other provisions will remain in effect and will be construed as if the invalid or unenforceable provision were not contained herein.

MISCELLANEOUS: These Official Rules contain the full and complete understanding with respect to the Sweepstakes and supersede all prior and contemporaneous agreements, representations and understandings, whether oral or written. The headings herein are for convenience only, do not constitute a part of these Official Rules, and shall not be deemed to limit or affect any of the provisions hereof. No amendment to, or waiver of, any provision of these Official Rules shall be effective unless in writing and signed by both Sponsor and Administrator. The waiver by Sponsor or Administrator of any provision of these Official Rules shall not constitute a waiver of any other provision herein. The rights and obligations hereunder may not be assigned by Entrant, whether by operation of law or otherwise, without the prior written consent of Sponsor, and any attempted assignment in violation of the foregoing shall be null and void. These Official Rules shall be binding upon, and inure to the benefit of, the permitted successors and assigns of Sponsor, Administrator, and Entrant.

The “Back to School” Sweepstakes (the “Sweepstakes”) is intended only for legal United States residents in all states (excluding Vermont; including the District of Columbia), and shall only be construed and evaluated according to U.S. law. No substitution, assignment or transfer of the Prize is permitted, except by Sponsors, who reserve the right to substitute the Prize with another of equal or greater value.

 

By accepting a Prize, the Winners agree to release and hold harmless the Released Parties, each of their related companies, and each of their respective officers, directors, employees, shareholders, and agents from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of the Prize. The potential Grand Prize Winners must each sign and return to the Administrator, within five (5) days of the date of notice or attempted notice is sent, an Affidavit of Eligibility, Liability & Publicity Release in order to claim his/her Prize. Note: The Affidavit sent to a potential Grand Prize Winner will require that the Winner provide their Social Security Number to the Administrator, which will be used solely for tax reporting purposes. The Prize Winners will each be responsible for all local, state, and federal taxes associated with the receipt of the Prize. The Grand Prize Winners must note that the value of their accepted Prize is taxable as income and an IRS Form 1099 will be filed in the name of the Winner for the value of their Prize. All Winners are solely responsible for all matters relating to the Prize after it is awarded. If a Prize or Prize notification is returned as unclaimed or undeliverable to a potential Winner, if a potential Winner cannot be reached within two (2) calendar days from the first notification attempt, or if a potential Grand Prize Winner fails to return requisite document(s) within the specified time period, or if a potential Winner is not in compliance with these Official Rules, then such person shall be disqualified and, at Sponsors’ sole discretion, an alternate Winner may be selected for the Prize at issue.

 

By accepting a Prize, where permitted by law, the Winners grant to the Released Parties and those acting pursuant to the authority of Sponsors and the Released Parties (which grant will be confirmed in writing upon Sponsors’ request), the right to print, publish, broadcast and use worldwide IN ALL MEDIA without limitation at any time their full name, portrait, picture, voice, likeness and/or biographical information for advertising, trade and promotional purposes without further payment or additional consideration, and without review, approval or notification. IN NO EVENT WILL RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF PARTICIPATION IN THIS SWEEPSTAKES OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE. By participating, Entrants release and agree to hold harmless the Released Parties from any and all liability for any injuries, death or losses or damages to persons or property AS WELL AS CLAIMS/ACTIONS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY that may arise from participating in this Sweepstakes or its related activities or the acceptance, possession, use or misuse of, or any harm resulting from the acceptance, possession, use or misuse of the Prize. The Winners also acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Prize.

 

DISPUTES: By entering the Sweepstakes, Entrants agree that i) Any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes, or any Prizes awarded, shall be resolved individually, without resort to any form of class action; ii) Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes but in no event attorney fees and iii) Under no circumstances will any Entrant be permitted to obtain any award for, and Entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrants and Sponsors or the Released Parties in connection with the Sweepstakes, shall be governed by, and construed in accordance with United States law. Any legal proceedings arising out of this Sweepstakes or relating to these Official Rules shall be instituted only in the federal or state courts of Ohio or California (Sponsors’ discretion), and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these Official Rules. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

 

SEVERABILITY: The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. If any provision of the Official Rules is determined to be invalid or otherwise unenforceable, the other provisions will remain in effect and will be construed as if the invalid or unenforceable provision were not contained herein.

 

MISCELLANEOUS: These Official Rules contain the full and complete understanding with respect to the Sweepstakes and supersede all prior and contemporaneous agreements, representations and understandings, whether oral or written.  The headings herein are for convenience only, do not constitute a part of these Official Rules, and shall not be deemed to limit or affect any of the provisions hereof.  No amendment to, or waiver of, any provision of these Official Rules shall be effective unless in writing and signed by both Sponsors and Administrator.  The waiver by Sponsors or Administrator of any provision of these Official Rules shall not constitute a waiver of any other provision herein.  The rights and obligations hereunder may not be assigned by Entrant, whether by operation of law or otherwise, without the prior written consent of Sponsors, and any attempted assignment in violation of the foregoing shall be null and void.  These Official Rules shall be binding upon, and inure to the benefit of, the permitted successors and assigns of Sponsors, Administrator, and Entrant.
